GMH attorneys Jared Trust and David Occhiuto recently obtained a defense verdict in a Ob/Gyn malpractice jury trial in Macomb County Circuit Court.
Jared and David represented an Ob/Gyn whereby Plaintiff alleged that the physician committed medical malpractice and fraud during/following a bilateral salpingo-oophorectomy. The attorney for the Plaintiff claimed the surgery, although indicated, was improperly performed leading to incomplete removal and later regrowth of the ovarian tissue causing both extensive economic and non-economic damages.
Over the course of the trial, the defense was able to exclude a notorious and well-seasoned economic damages expert and elicited exceptional treating physician and expert testimony demonstrating that the Plaintiff’s claims were without merit and certainly not fraudulent. The jury fully agreed.
